Please note that the process and the form for giving Temporary Event Notices changed on 25 April 2012.
Temporary Event Notices may be given for carrying out licensable activities (i.e. sale and supply of alcohol, provision of regulated entertainment and the provision of late night refreshment) on a temporary basis - for example, a 'one off' or occasional event. Temporary Event Notices (TENs) can be applied for to permit the following temporary licensable activities whether they are within a premise or outside in open space:
- Regulated entertainment - plays, films, recorded music, indoor sporting events, live music, boxing or wrestling entertainment, performance of dance
- Late night refreshment - provision of hot food and/or hot drinks between 11pm and 5am
- Sale by retail of alcohol
- Supply of alcohol by or on behalf of a club to a member or to the order of a member.
There are certain limits, including:
- The event must be for no more than 499 people (including staff and performers)
- The event must be for no more than 168 consecutive hours
- There must be at least 24 hours between two TENs given for the same premises by the same person or an associate
- A Personal Licence holder may give no more than fifty standard or ten late TENs per calendar year
- An individual who does not hold a personal licence may give no more than five standard or two late TENs per calendar year
- No more than twelve TENs may be given for a particular premises in a calendar year
- TENs may be given for a particular premises for no more than twenty one days in a calendar year (a day includes part of a day, so an event running from 6pm on one day until 6am the next is classed as a two day event)
There are now two types of TENs - a standard TEN and a late TEN.

Eligibility criteria
The temporary event notice should contain:
- if alcohol is to be supplied, a statement confirming that it is a condition of using the premises that the supplies are made under your authority.
- a statement relating to certain matters.
- any other required information.
The matters referred to above are:
- details of the licensable activities.
- the event period.
- the times when during that period the activities will take place.
- the maximum number of people proposed to be allowed on the premises
- any other required matters.
Application Evaluation Process
If the TEN is given in writing by post, it must be in duplicate, and must be received by us at least ten working days before the event. If you apply online, you need only complete the form once. A fee of £21 is payable with the notice.
A TEN must be served on the licensing authority, environmental health and metropolitan police
Procedure - standard TEN
Provided that a completed application has been submitted and the limits in respect of temporary event notices have not been exceeded, the Licensing Authority will acknowledge your application by returning a receipted copy of your application form to you. If the limits have been exceeded the Licensing Authority will serve a counter notice and the event will not be permitted and any activity that did take place would not be authorised.
The Police or Environmental Health may object if they think the event will adversely affect any of the four licensing objectives:
- Prevention of crime & disorder
- Prevention of public nuisance
- Public safety
- Protection of children from harm
If this happens and the matter cannot be resolved through mediation, there will be a hearing to decide whether or not the event will proceed. It should be noted that if the TEN is for an event on a premises / area already covered by a premises licence or club certificate then conditions on that licence can be put on the TEN if it is felt appropriate.
Procedure - late TEN
A late TEN is a Temporary Event Notice that is given to the Licensing Authority, the Police and Environmental Health between 5 and 9 clear working days of the proposed event - Please be aware this does not include the day you submit the notice or the day of the event.
You are advised that by applying for a late TEN you run the risk that your event will not be able to take place, should the licensing authority receive an objection notice to a late TEN they are required to serve a counter notice no later than 24 hours before the event and the event will not then be permitted. Hearings are not permitted for late TENs.
The temporary event notice must be available for inspection at any given time during the event, and the premise user must be responsible for licensable activity taking place on the premises. Please ensure that all applicants read and familiarise themselves with the conditions on the application form.
If you apply by post you must also give notice to the Police Licensing Officer of Metropolitan Police Service and Enforcement Response team no later than ten working days before the event. If you apply online we will send a copy of your notice to the police and enforcement response for you. The address of the relevant police station and enforcement response is:

Will Tacit Consent apply?
Yes. This means you will be able to act as though your notice is granted if you have not heard from us after ten working days.
Where tacit consent is applicable, it only applies for licences / registrations that are submitted electronically or the business can show proof of delivery from a post office or recognised courier.

Terms and conditions
- We cannot accept liability if payment is refused or declined by the card supplier.
- If the card supplier declines payment, the Council is under no obligation to bring this fact to the customer's attention.
- Customers should check with their card supplier to ensure that payment has been deducted from their relevant account.
- Due to end of day processing, this service will not be available between 10pm and 11pm every weekday evening (Mon- Fri).
- Users should note that any payments in process after the 10pm deadline need to be completed by 10.05pm.

If a counter notice is given in relation to an objection notice the applicant may appeal against the decision. Appeals must be made to the local Magistrates' court within 21 days. An appeal may not be brought later than five working days from the day of the planned event. Please note, this does not apply to late TENs.

Other Redress
If a licensing authority decides not to issue a counter notice in relation to an objection notice the chief police officer can appeal the decision. Appeals must be made to the local Magistrates' court within 21 days. An appeal may not be brought later than five working days from the day of the planned event.
