Company fined after waste contractor dumps rubbish

A company whose waste was dumped in a Tottenham Street was fined £2,000 and made to pay costs of £1,300 by Tottenham Magistrates last month.

The man driving the vehicle which dumped the waste was given a one year community order and made to pay £200 costs.

The case was brought to court by Haringey enforcement officers after a resident reported Ian Williams, of 21 Mornington Road, SE8, dumping a large quantity of household waste in Moria Close N17 last December.

The resident called the police who arrested Mr Williams and passed on the case to the council for investigation.

Mr Williams was later charged with flytipping and the company, Mount Place Limited, was charged with failing in their duty of care to dispose of their waste.

Fly tipping is an offence under the Environmental Protection Act 1990. If a business gives their waste to someone who later dumps it the business is responsible under the Act.

Cllr Nilgun Canver, Cabinet Member for Neighbourhoods, said: "Companies and householders must be aware that if they employ someone to take away their waste and this is not disposed of correctly then they will be liable. Always check that you are using a licensed carrier and that they dispose of waste in a licensed tip."

On September 22 at Tottenham Magistrates Court Mr Williams was found guilty of fly tipping and sentenced to a 1 year community order with 80 hours unpaid work. He was also ordered to pay £200 costs. The court was also made aware that Mr. Williams had a previous conviction for a similar offence, for which he was fined £300, and was known to the police and council as a prolific fly tipper.

Mount Place Limited were found guilty of two offences of failing in their duty of care in preventing their waste being fly tipped and were sentenced to a £1000 fine for each offence, £1,300 costs and £15 victim surcharge - a total of £3,315.

Illegal Street Trader caught selling stolen Spurs goods

An illegal street trader has been fined for selling stolen Spurs paraphernalia outside the ground before a match last December.

Cllr Nilgun Canver, Cabinet Member For Neighbourhoods, said:

"It's interesting that when you stop someone for illegal street trading other crimes can come to light. Here was someone with no licence being brazen enough to sell stolen branded goods under the noses of the football club. In the end it's the fans who pay as theft pushes up the price of these goods."

Mr Ali Gokdogan of 9 Carlisle Walk, Rhodes Estate, E8 3SX, was found guilty of illegal street trading and handling stolen goods after he was caught during an operation involving Haringey enforcement officers, police and the Intellectual Property Crime Unit.

The operation was set up to catch illegal street traders selling counterfeit goods to fans attending match days at Tottenham Hotspur Football Club.

Mr Gokdogan was caught selling Spurs branded hats, scarves and gloves outside the ground even though he had no trading licence, contrary to section 38 of the London Local Authorities Act 1990.

Further checks revealed that the goods were part of a large batch of stolen goods taken in a burglary in September 2009.

Street Enforcement officers confiscated the goods and money from Mr Gokdogan and he was arrested and charged to appear in June at Tottenham Magistrates Court for an allegation of illegal street trading of which he was convicted.

On the 25 August 2010, Mr. Gokdogan was also found guilty of handling stolen goods and sentenced to a 12 month conditional discharge and ordered to pay £300 costs.

Litter bug pays the price

On 26 April 2010 Mr Peter Panayitou was found guilty by Tottenham Magistrates for throwing down litter in the street. Littering is an offence contrary to the Environmental Protection Act 1990.

On the 9 October 2009 Mr Panayitou was observed outside a Social Club in Wood Green throwing down a cigarette onto the street. He was challenged by a Street Enforcement Officer and was issued with a £75 fixed penalty notice.

Mr Panayitou subsequently refused to pay the fixed penalty and was prosecuted.

The Magistrates ordered Mr Panayitou to pay £100 fine, £15 victim surcharge and £200 costs.

This successful prosecution was part of a wider borough wide campaign to reduce littering. Within this programme Street Enforcement Officers identified a range of similar locations where smoking related litter was a particular problem for targeted enforcement action.

These successful prosecutions are part of a borough wide campaign to reduce littering. Within this program of work Street Enforcement Officers working with local Safer Neighbourhood Police patrols identified litter hot spots. There was zero tolerance for individuals that littered.

In October 2010 as part of the Litter Enforcement operation Ms Alice Doherty was observed in Wood Green throwing down a cigarette onto the street. She was challenged by a Street Enforcement Officer and was issued with a £75 fixed penalty notice.

Ms Doherty subsequently refused to pay the fixed penalty and the matter was referred for prosecution.

Ms Doherty was found guilty in January 2011 at Tottenham Magistrates Court and sentenced to pay £175 fine, £15 victim surcharge and £150 costs.

In June 2010 as part of the Litter Enforcement operation Mr Jadael Meloni was observed in Wood Green throwing down a cigarette onto the street. He was challenged by a Street Enforcement Officer and was issued with a £75 fixed penalty notice.

Mr Meloni subsequently refused to pay the fixed penalty and the matter was referred for prosecution.

Mr Meloni was found guilty in January 2011 at Tottenham Magistrates Court and sentenced to pay £175 fine, £15 victim surcharge and £150 costs.

In June 2010 as part of the Litter Enforcement operation Mr Myvedete Zhipotov was observed in Wood Green throwing down a cigarette onto the street. He was challenged by a Street Enforcement Officer and was issued with a £75 fixed penalty notice.

Mr Zhipotov subsequently refused to pay the fixed penalty and the matter was referred for prosecution.

Mr Zhipotov was found guilty in January 2011 at Tottenham Magistrates Court and sentenced to pay £175 fine, £15 victim surcharge and £150 costs.

Mr Rassuli was found guilty in September 2010 at Tottenham Magistrates Court and sentenced to pay £175 fine, £15 victim surcharge and £150 costs.

Mr Gafra subsequently refused to pay the fixed penalty and the matter was referred for prosecution.

Mr Gafra was found guilty at Tottenham Magistrates Court and sentenced to pay £175 fine, £15 victim surcharge and £300 costs.

In October 2010 Mr Suleyman Suyolcu was found guilty by Tottenham Magistrates for Littering from a vehicle – namely cigarette dropped onto public highway.

In June 2010 a Street Enforcement Officer working as part of the litter enforcement operation witnessed the driver of a people carrier on White Hart Lane throw out a cigarette butt on to the public highway. Littering is an offence under Section 87 the Environmental Protection Act 1990.

The officer recorded the details of the incident and then carried out checks to identify the vehicle's registered owner. Once the registered owners details were obtained, a notice was issued. The notice required the owner to supply the details of the driver at the time of the alleged offence. Failure to provide the requested details is an offence punishable by prosecution, the keeper can also be issued with a fixed penalty for the original offence of littering.

The registered keeper failed to respond to the notice, and ignored further warning letters. The matter was referred to the courts for prosecution.

Mr Suyolcu failed to attend court and the Magistrates sentenced him to pay £175 fine, £15 victim surcharge and £291 costs.

In October 2010 as part of the Litter Enforcement operation Mr Volkan Yigit, was observed on Great Cambridge Road, throwing a cigarette from his vehicle onto the public highway. He was issued with a £75 fixed penalty notice.

Mr Yigit subsequently refused to pay the fixed penalty and the matter was referred for prosecution.

Mr Yigit was found guilty in January 2011 at Tottenham Magistrates Court and sentenced to pay £175 fine, £15 victim surcharge and £150 costs.

In August 2010 as part of the Litter Enforcement operation Mr Awil Mahmoud was observed on Great Cambridge Road, throwing a cigarette from his vehicle onto the public highway. He was issued with a £75 fixed penalty notice.

Mr Mahmoud subsequently refused to pay the fixed penalty and the matter was referred for prosecution.

Mr Mahmoud was found guilty in January 2011 at Tottenham Magistrates Court and sentenced to pay £75 fine, £15 victim surcharge and £150 costs.

In August 2010 as part of the Litter Enforcement operation Ms Bridget Turgoose was observed in Wood Green throwing down a cigarette onto the street. She was challenged by a Street Enforcement Officer and was issued with a £75 fixed penalty notice.

Ms Turgoose subsequently refused to pay the fixed penalty and the matter was referred for prosecution.

Ms Turgoose was found guilty in January 2011 at Tottenham Magistrates Court and sentenced to pay £150 fine and £150 costs.
