Litter Enforcement Statement 2010 - 2011

Littering is an antisocial and criminal act, and we will use our enforcement powers to make those responsible pay a penalty. Our approach will be to issue fixed penalty notices, without warning, for all littering offences identified, and to use our additional powers to ensure those responsible for litter arising from their business or ownership are held accountable. Those that do not pay fixed penalties, or are repeat offenders can expect to be prosecuted.

Our Street Enforcement service will undertake at least one litter patrol per week targeting problem locations and businesses for enforcement.

We will also promote responsible trading and will help businesses go beyond their legal responsibilities to demonstrate how they care for neighbourhoods in which they operate. Through our responsible trader scheme we will celebrate the positive contributions that are made.

Littering

Littering is defined under the Environmental Protection Act 1990 as an incidence where any person throws down, drops or otherwise deposits in, into or from any place and leaves anything whatsoever in such circumstances as to cause, or contribute to, or tend to lead to, the defacement by litter of any place.

Our Priorities

We will our activities to focus on 4 priorities in 2010/11. These are:

  1. Litter from vehicles
  2. Litter from fast food
  3. Smoking related litter
  4. Litter on unswept land

Litter discarded from vehicles, particularly on our major roads and junctions presents a potential safety risk to other road users, provides a particularly expensive cleansing task for the borough, and due to the requirement for or lane closures, causes congestion and inconvenience to other road users.

Fast food litter is one of the most common forms of litter found in the borough. Those that supply fast food packaging will be expected to actively minimise the potential for littering by their customers, and to ensure their business litter does not accumulate in the vicinity of their business.

Smoking and tobacco related waste is a major source of litter in the borough. It is can be a problem associated with businesses such as clubs, pubs, cafes and betting shops and around our public transport infrastructure. It is expected that businesses will take responsibility for the litter that is associated with their clients and employees, and that they will make arrangements to encourage the responsible disposal of litter. Smokers should be prepared to dispose of their cigarette butts by carrying suitable pouches of similar containers.

We expect that all land and property owners should take responsibility for keeping their land and property swept and free of litter. As well as using our powers to require action, We will identify and publish on our website, the locations of land which we feel are not adequately cared for as part of our public eyesores programme.
