Fixed Penalty Notices
What is a Fixed Penalty Notice?
Fixed Penalty Notices are issued by local authority officers for certain offences where the legislation permits and where the officer is authorised to do so. They provide a quick, visible and effective way of dealing with low-level environmental crimes, and are an alternative to prosecution.
A Fixed Penalty Notice may only be issued where an officer has reason to believe a person has committed a penalty offence and there is sufficient evidence to support a successful prosecution.
A fixed penalty is not a fine. Payment of the penalty by the recipient discharges their liability to conviction for the offence for which the FPN was issued. It does not constitute an admission of guilt, but removes the possibility of the creation of a record of criminal conviction.
Paying a Fixed Penalty Notice
By cheque: Cheques should be made payable to the 'Haringey Council' and sent to the address below.
By cash: Payment by cash can be made in person at the address below.
Contesting a Fixed Penalty Notice
If you do not accept that you should pay a fixed penalty or consider you have not committed an offence you should write to the Council within 14 calendar days setting out your reasons and quoting the Fixed Penalty Notice reference number.
Failure to pay or contest a Fixed Penalty Notice
If you do not pay or contest the fixed penalty within 14 calendar days the Council may decide to prosecute you under the relevant statute. If we decide to do this you will receive a Summons to appear at a Magistrates’ Court. Should the Council decide to prosecute you in court you will be able to state your case in front of magistrates.
